Trump 2.0 – The Pen is Mightier Than The Sword & Bonus Missouri Paid Sick Leave Developments

President trump made a historic return to the Whitehouse on January 20, 2025.Now unburdened by having to seek a second term, the Trump 2.0 Administration has been operating at a breakneck pace. With democrats in Congress being unable to stop his agenda, they and the Washington bureaucratic class have turned to the Court system to stop – or at least slow down – the administration’s plans. During this session, we will examine Trump’s Executive Orders (and proclamations) as they relate to labor and employment law, what to expect from Congress through the midterm elections (in 2026), and what to expect from the three primary labor and employment administrative agencies (DOL, EEOC, and NLRB) under the second Trump administration.

Burton Garland practices all facets of labor and employment law. Burt’s labor law practice includes union avoidance counseling and campaigns, elections, objections to elections, R-Case strategy and litigation, collective bargaining, strikes and injunctions, arbitration, and unfair labor practice charges before the National Labor Relations Board.
Burt’s employment practice includes litigating employment discrimination matters under Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, Fair Labor Standards Act, the Federal False Claims Act, and the various state counterparts to these federal laws. Burt has extensive experience litigating high stakes matters in the context of motions seeking temporary restraining orders and other injunctive relief matters involving restrictive covenants (non-compete, non-solicit and confidentiality agreements); misappropriation of trade secrets; retaliation; tortious interference; unfair competition; and related claims. In addition to representing clients in federal and state court and before federal and state agencies, Burt’s practice includes advising clients on employment-related matters and drafting personnel policies, employment contracts, severance agreements, and employee handbooks. He also has significant experience in wage and hour class action defense and in FINRA arbitrations. Burton has appeared in federal and state courts and agencies throughout the country and is permanently admitted to practice law both in Missouri and Illinois.

This session will provide an informative overview of the fair employment rights and responsibilities under the Missouri Human Rights Act, including sex, disability, age, race, color, national origin, ancestry, religion, association, and retaliation; detail the administrative complaint process from intake through public hearing, including early resolution; and share best practices for employers.
Kristy A. Lambert, Director of Compliance/Legal Counsel
Missouri Commission on Human Rights
Kristy A. Lambert is Director of Compliance/Legal Counsel with the Missouri Commission on Human Rights (MCHR), which enforces the state’s anti-discrimination law in employment, housing, and public accommodations. She also manages MCHR’s intern and volunteer program and conducts education and outreach programs.
Ms. Lambert is a Vice Chair of the Alternative Dispute Resolution Committee of The Missouri Bar and has been appointed by the Board of Governors of The Missouri Bar to the Joint Commission on Women in the Profession, on which she has served since 2021. She is an Ambassador of United WE, formerly Women’s Foundation. The U.S. Commission on Civil Rights appointed her to a four-year term as a member of a State Advisory Committee; the Commission is an independent, bipartisan federal agency charged with advising the President and Congress on civil rights matters and issuing an annual federal civil rights enforcement report. She also served several years on the Project Equality Steering Committee.
Ms. Lambert earned her Juris Doctorate degree from the University of Kansas School of Law and graduated with Phi Kappa Phi honors from Oklahoma State University in Business Administration. She is licensed to practice law in Missouri, Kansas, and Oklahoma and was admitted to the bar of the U.S. Supreme Court. A native of Oklahoma, Ms. Lambert sings First Soprano with the Kansas City Symphony Chorus.
